1. ABOUT ADVENTIS
Adventis is a South African-based luxury travel company specialising in bespoke African journeys, including safari, adventure, family, cultural, conservation, faith and other travel experiences.
Adventis acts as a travel adviser, curator and/or arranger of travel services.
Depending on the journey, Adventis may arrange services supplied by independent third parties, including:
- airlines;
- hotels;
- safari lodges and camps;
- destination management companies;
- guides;
- drivers;
- transfer companies;
- activity operators;
- conservation organisations;
- marine operators;
- adventure providers;
- restaurants;
- local hosts; and
- other travel suppliers.
Unless expressly stated otherwise in writing, Adventis does not own, operate or control these third-party suppliers.
2. DEFINITIONS
For purposes of these Terms:
"Adventis" means Adventis Travel, trading as Adventis.
"Client", "you" or "your" means the person purchasing, requesting or participating in the travel services.
"Journey" means the itinerary, travel arrangements, services or experiences arranged or curated by Adventis.
"Supplier" means any third-party provider involved in delivering part of a Journey.
"Quotation" means the proposed itinerary and pricing provided by Adventis.
"Booking" means a confirmed travel arrangement accepted by the Client and Adventis.
"Deposit" means any amount required to confirm a Booking.
"Balance" means the remaining amount payable after payment of the Deposit.
3. OUR ROLE
Adventis's role may include:
- understanding your requirements;
- recommending destinations and experiences;
- designing itineraries;
- obtaining quotations;
- communicating with Suppliers;
- making reservations;
- coordinating arrangements;
- providing travel information;
- assisting with changes where possible; and
- providing travel support in accordance with the services agreed with you.
Adventis does not guarantee that every requested service, room category, flight, activity, wildlife sighting, guide, vehicle or experience will be available.
Availability is subject to Suppliers and destination conditions.
4. TRAVEL QUOTATIONS
All quotations are subject to availability at the time of booking.
Unless expressly stated otherwise, a quotation is not a confirmed Booking.
Prices may change before confirmation because of:
- supplier availability;
- exchange-rate fluctuations;
- airfare changes;
- accommodation pricing;
- taxes;
- government charges;
- fuel levies;
- conservation fees;
- park fees;
- changes imposed by Suppliers; or
- other circumstances outside Adventis's reasonable control.
A quotation will specify the currency and validity period where applicable.
If a quotation expires before acceptance, Adventis may need to re-price the Journey.
5. BOOKING CONFIRMATION
A Booking becomes confirmed only when:
- Adventis has confirmed the relevant arrangements in writing;
- the required Deposit or other payment has been received; and
- the Supplier has confirmed the relevant services, where applicable.
A payment alone does not necessarily mean that every component of a Journey has been confirmed unless Adventis confirms this in writing.
6. DEPOSITS AND PAYMENTS
The Deposit required will be stated in the applicable quotation or invoice.
Payment deadlines are material to the Booking.
If a required payment is not received by the stated deadline, Adventis or the relevant Supplier may cancel or release the reservation.
Any resulting cancellation charges, supplier penalties, non-refundable amounts or price increases may be payable by the Client.
The final payment deadline will be stated in the Booking documentation.
Unless otherwise agreed in writing, the Journey must be paid in full before departure.
7. PAYMENT METHODS
Payments may be made using payment methods specified by Adventis.
Where payment is processed through a third-party payment provider, that provider's terms may also apply.
The Client is responsible for providing accurate payment information and ensuring that sufficient funds are available.
Bank charges, international transfer fees, currency-conversion charges or other payment costs may be payable by the Client unless expressly included in the quotation.
8. CURRENCY AND EXCHANGE RATES
Unless otherwise stated, prices will be quoted in the currency specified on the quotation.
Where Supplier charges are denominated in another currency, Adventis may convert those charges for quotation purposes.
Exchange rates may fluctuate.
If an exchange-rate movement materially changes the cost of Supplier services before full payment, Adventis may adjust the amount payable where permitted by the Booking terms and applicable law.
9. THIRD-PARTY SUPPLIERS
Adventis works with carefully selected third-party travel suppliers and partners to arrange and deliver elements of your Journey.
These may include accommodation providers, safari lodges and camps, destination management companies, transport providers, guides, activity operators, airlines and other travel service providers.
Africa Tour is one of Adventis’s trusted African travel partners and may assist with the planning, coordination and delivery of safari and other travel arrangements within Africa.
Where flights are requested, Adventis may also work with Unashamed Travel, or another appropriate third-party travel specialist, as described further in Section 11.
Third-party suppliers are independent businesses and are responsible for the services they provide. Their own terms and conditions, cancellation policies, payment requirements and operational requirements may apply to the relevant portion of your Journey.
Adventis will communicate relevant supplier requirements to you where reasonably practicable and will assist with coordination where appropriate. However, Adventis does not control the day-to-day operations of independent suppliers and cannot guarantee the continued availability, operation or performance of any particular supplier or service.
Where a particular supplier is identified in your Booking Confirmation or itinerary, that supplier’s applicable terms and conditions may also form part of the arrangements applicable to your Journey.
Each Supplier may have its own:
- booking conditions;
- cancellation policy;
- payment conditions;
- baggage restrictions;
- age restrictions;
- medical requirements;
- participation requirements;
- liability provisions;
- safety requirements; and
- other terms.
By accepting a Booking, you agree to comply with applicable Supplier terms.
Where Supplier terms are more restrictive than these Terms, the Supplier’s specific terms may apply to the relevant service.
Adventis will communicate material Supplier terms to you where reasonably practicable.
10. SUPPLIER CHANGES
Suppliers may occasionally change:
- accommodation;
- room categories;
- schedules;
- routes;
- vehicles;
- guides;
- activities;
- flight times;
- departure times;
- operating procedures; or
- other elements of a Journey.
Where this occurs, Adventis will use reasonable efforts to notify you and, where appropriate, assist with alternative arrangements.
Adventis cannot guarantee that an alternative will be identical to the original arrangement.
11. AIR TRAVEL
Where flights are requested as part of a Journey, Adventis may arrange flights through a reputable third-party travel specialist, Unashamed Travel, or another appropriate flight provider.
Flight arrangements are subject to the applicable airline and/or third-party travel provider’s terms and conditions, including their payment, ticketing, amendment, cancellation, baggage, seating and refund policies.
Adventis may assist with coordinating flight arrangements and communicating with the relevant travel provider on the Client’s behalf. However, airlines and flight providers are independent third parties, and Adventis does not operate or control the aircraft, airline schedules, airport operations or other aspects of air carriage.
Flight schedules, routes, fares, aircraft, seating and other arrangements are subject to change by the relevant airline or travel provider. Any such changes will be communicated to the Client as soon as reasonably practicable once Adventis becomes aware of them.
Where flights are booked through a third-party provider, the Client acknowledges that the provider may require certain personal information, travel documentation and payment information in order to make and service the booking. Further information about the sharing of personal information is set out in Adventis’s Privacy Policy.
The Client remains responsible for ensuring that all flight information supplied to Adventis is accurate and that all applicable airline requirements, including passport, visa, health, baggage and check-in requirements, are met.
Adventis is not responsible for:
- flight delays;
- cancellations;
- missed connections;
- denied boarding;
- baggage loss;
- baggage delays;
- baggage damage;
- airline strikes;
- aircraft changes;
- schedule changes;
- overbooking; or
- other airline-related events,
except to the extent that applicable law provides otherwise.
Clients are responsible for checking their flight information and complying with airline requirements.
12. PASSPORTS, VISAS AND ENTRY REQUIREMENTS
You are responsible for ensuring that you have:
- a valid passport;
- sufficient passport validity;
- appropriate visas;
- required permits;
- sufficient blank passport pages where applicable;
- required vaccination or health documentation;
- any required parental or child-travel documentation; and
- all other documents required for entry, transit and departure.
Adventis may provide general information regarding visa and entry requirements, but requirements can change.
Ultimate responsibility for ensuring that you are legally permitted to enter, transit through and leave a country rests with you.
Adventis is not responsible for costs or losses arising from incorrect, incomplete, expired or unavailable travel documentation.
13. TRAVEL INSURANCE
Adventis strongly recommends that Clients obtain appropriate travel insurance for their Journey. Where available and appropriate, Adventis may arrange or facilitate travel insurance through a third-party insurance provider and may include the relevant insurance option in the Client’s Quotation.
Any travel insurance arranged through Adventis is provided by the relevant third-party insurer and is subject to that insurer’s policy wording, terms, conditions, exclusions, limitations and claims procedures. Adventis is not the insurer and does not determine whether a claim is covered or payable.
The Client is responsible for reviewing the proposed insurance policy before accepting it and for ensuring that the level and scope of cover is appropriate for their circumstances and Journey. Depending on the Journey, appropriate cover may include cancellation or curtailment, medical expenses, emergency medical evacuation and repatriation, baggage and personal belongings, travel delays, personal liability and cover for any adventure or safari activities included in the Journey.
Where a Client declines travel insurance or chooses insurance independently of Adventis, the Client acknowledges that Adventis cannot be responsible for losses, costs or expenses that could otherwise have been covered by appropriate insurance, to the extent permitted by law.
Any insurance premiums, policy fees, excesses and claims are subject to the terms of the relevant insurance provider.
Depending on the Journey, appropriate insurance cover may include:
- medical expenses;
- emergency evacuation;
- repatriation;
- trip cancellation;
- trip interruption;
- baggage;
- personal liability;
- adventure activities;
- wildlife activities;
- missed connections;
- travel delays; and
- other relevant risks.
Clients are responsible for ensuring that their insurance is appropriate for the Journey and covers all activities they intend to undertake.
14. HEALTH AND MEDICAL REQUIREMENTS
Certain destinations and activities may involve health or medical considerations.
You are responsible for obtaining appropriate professional medical advice before travelling where necessary.
You must inform Adventis of any medical, mobility, dietary, allergy or other requirement that may materially affect the safety or feasibility of your Journey.
Adventis may share relevant information with Suppliers where necessary to arrange your travel safely.
You acknowledge that certain activities may not be suitable for every traveller.
15. SAFARI AND WILDERNESS RISKS
IMPORTANT RISK NOTICE
African safari and wilderness travel may involve inherent risks that do not exist, or may be less common, in ordinary urban travel.
These may include:
- encounters with wild animals;
- wildlife attacks;
- insects and parasites;
- snakes;
- mosquitoes;
- waterborne or foodborne illness;

- altitude;
- bush fires;
- road conditions;
- aircraft or helicopter travel;
- remote-area transfers;
- vehicle accidents;
- physical injury;
- serious illness; and
- in exceptional circumstances, death.
Wild animals are unpredictable and cannot be completely controlled.
Guests must follow all instructions given by guides, rangers, camp staff, pilots, drivers and activity operators.
Guests must never approach, feed, touch, pursue, provoke or otherwise interfere with wildlife unless expressly instructed by an appropriately qualified professional.
The nature and potential effects of unusual or serious risks associated with certain activities will be brought to the Client's attention as required by applicable law.
16. ADVENTURE ACTIVITIES
Some Journeys may include activities such as:
- hiking;
- walking safaris;
- cycling;

- snorkelling;
- boating;

Participation may be subject to:
- age restrictions;
- health requirements;
- weight or height limits;
- experience requirements;
- weather conditions;
- Supplier requirements;
- equipment requirements; and
- safety assessments.
You agree to follow all reasonable safety instructions.
A Supplier may refuse participation if it reasonably considers the activity unsafe or unsuitable.
17. WILDLIFE SIGHTINGS AND NATURAL PHENOMENA
Wildlife encounters are inherently unpredictable.
Adventis does not guarantee sightings of:
- particular animals;
- particular species;
- migrations;
- predators;
- marine life;
- specific behaviours;
- weather conditions;
- sunsets;
- landscapes; or
- other natural phenomena.
Photographs and promotional materials are intended to illustrate the type of experience that may be available and do not constitute a guarantee that you will experience the same sighting or conditions.
18. ITINERARY CHANGES
Adventis may recommend or implement reasonable itinerary changes where necessary because of:
- weather;
- wildlife conditions;
- road conditions;
- park closures;
- conservation requirements;
- safety;
- Supplier changes;
- flight changes;
- government requirements;
- political or civil conditions;
- natural disasters;
- illness;
- mechanical failure;
- operational requirements; or
- other circumstances outside Adventis's reasonable control.
Where reasonably possible, we will seek alternatives of a comparable nature.
Additional costs arising from Client-requested changes will generally be for the Client's account.
19. FORCE MAJEURE
Adventis shall not be responsible for failure, delay or alteration of a Journey caused by circumstances beyond our reasonable control.
Such circumstances may include:
- natural disasters;
- severe weather;
- floods;
- fires;
- epidemics or pandemics;
- disease outbreaks;
- war;
- terrorism;
- civil unrest;
- political instability;
- border closures;
- government restrictions;
- strikes;
- industrial disputes;

- infrastructure failure;
- power failures;
- telecommunications failures;
- cyber incidents;
- wildlife events;
- conservation closures;
- Supplier failure;
- transport disruption; or
- other extraordinary circumstances beyond our reasonable control.
Where such circumstances occur, Adventis will use reasonable efforts to assist the Client and seek practical alternatives.
Refunds, credits or compensation will depend on the circumstances, the applicable Supplier terms, insurance coverage and applicable law.
20. CLIENT-REQUESTED CHANGES
Requests to change a confirmed Journey may result in:
- amendment fees;
- Supplier penalties;
- fare differences;
- accommodation charges;
- cancellation charges;
- administrative fees;
- additional transport costs; or
- other costs.
The Client is responsible for such costs where they arise from a Client-requested change, subject to applicable law.
21. CANCELLATIONS BY THE CLIENT
Cancellation terms will depend on the specific Journey and the Suppliers involved.
Because many luxury safari arrangements require advance commitments and involve limited inventory, some components may be:
- non-refundable;
- partially refundable;
- subject to substantial cancellation fees; or
- fully refundable only within a specified period.
The cancellation terms applicable to your Journey will be set out in your quotation, Booking confirmation or Supplier terms.
If you cancel, Adventis will calculate the applicable cancellation amounts and advise you of any refundable balance, where applicable.
22. CANCELLATION BY ADVENTIS OR A SUPPLIER
Adventis or a Supplier may cancel or materially alter a Booking where necessary because of circumstances including:
- non-payment;
- Supplier closure;
- safety concerns;
- government restrictions;
- force majeure;
- operational reasons;
- availability issues;
- unlawful or inappropriate Client conduct; or
- other circumstances permitted by applicable law.
Where Adventis cancels a Journey for reasons within Adventis's control, we will provide the remedies required under the applicable Booking terms and law.
23. REFUNDS
Where a refund is due, the amount will depend on:
- the reason for cancellation;
- Supplier terms;
- amounts already paid to Suppliers;
- applicable cancellation penalties;
- insurance recoveries;
- applicable law; and
- the terms of the relevant Booking.
Adventis cannot refund money that a Supplier has lawfully retained where Adventis has no contractual or legal right to recover it.
Where Adventis receives a refund from a Supplier on the Client's behalf, Adventis will pass on the applicable refundable amount subject to any permitted fees or charges.
24. CLIENT RESPONSIBILITIES
Clients agree to:
- provide accurate information;
- disclose relevant travel requirements;
- provide correct passport information;
- make payments on time;

- follow safety instructions;

- respect local communities and cultures;
- behave respectfully toward staff and other travellers;
- maintain appropriate travel insurance;
- take reasonable care of personal belongings; and
- promptly notify Adventis of material changes affecting the Journey.
25. CLIENT CONDUCT
Adventis reserves the right to refuse or terminate arrangements where a Client engages in conduct that materially threatens:
- the safety of themselves;
- other guests;
- staff;
- guides;
- local communities;
- wildlife;
- Suppliers; or
- property.
Examples may include:
- violent behaviour;
- threatening behaviour;
- serious intoxication;
- harassment;
- discriminatory conduct;
- deliberate damage;
- unlawful conduct;
- refusal to follow safety instructions; or
- behaviour that materially disrupts the Journey.
Any resulting costs will be dealt with in accordance with applicable law and the relevant Supplier terms.
26. PERSONAL BELONGINGS
Clients are responsible for their own belongings.
Adventis is not responsible for loss, theft or damage to personal belongings except to the extent liability cannot lawfully be excluded or limited.
Clients should comply with accommodation and Supplier instructions concerning valuables and should maintain appropriate insurance.
27. PHOTOGRAPHY AND CONTENT
Adventis may photograph or record its own experiences for marketing purposes.

Clients may take photographs and videos during Journeys provided that they:
- follow local rules;
- follow Supplier instructions;
- respect wildlife;
- respect other guests;
- respect local communities; and
- do not interfere with safety or operations.
28. INTELLECTUAL PROPERTY
All intellectual property appearing on the Adventis website, including:
- logos;
- branding;
- text;
- graphics;
- photographs;
- videos;
- itinerary concepts;
- written content;
- designs; and
- other original material
is owned by or licensed to Adventis unless otherwise stated.
You may not reproduce, copy, modify, distribute, sell or commercially exploit Adventis content without written permission.
29. WEBSITE USE
You agree not to:
- misuse the website;
- introduce malicious software;
- attempt unauthorised access;
- interfere with website functionality;
- copy website content for commercial purposes;
- impersonate Adventis;
- submit false information; or
- use the website for unlawful purposes.
Adventis may suspend or restrict access where reasonably necessary to protect the website or its users.

However:
- destinations change;
- prices change;
- accommodation availability changes;
- Suppliers change their offerings;
- travel regulations change; and
- natural conditions change.
Website content should therefore not be treated as a guarantee that a particular service will be available or that a particular price will apply.
A confirmed Booking and its specific documentation govern your purchased arrangements.
31. THIRD-PARTY WEBSITES
The Adventis website may contain links to third-party websites.
Adventis does not control those websites and is not responsible for their:
- content;
- accuracy;
- availability;
- security;
- privacy practices; or
- terms.
32. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Adventis will not be liable for loss, damage, delay, expense or inconvenience arising from circumstances outside Adventis's reasonable control or from the acts or omissions of independent Suppliers.
This may include losses arising from:
- airline disruption;
- Supplier failure;
- accommodation issues;
- delays;
- cancellations;
- weather;
- wildlife;
- natural events;
- government action;
- border restrictions;
- illness;
- injury;
- lost luggage;
- theft;
- changes to schedules;
- road conditions; or
- other events outside Adventis's reasonable control.
Nothing in these Terms excludes or limits liability to the extent that such exclusion or limitation is prohibited by applicable law.
Nothing in these Terms excludes statutory consumer rights or liability that cannot lawfully be excluded.
33. SUPPLIER LIABILITY
Where a Supplier is responsible for a particular service, any claim relating specifically to that service may need to be made against the relevant Supplier under the Supplier's terms and applicable law.
Adventis will, where reasonably practicable, assist Clients in communicating with the relevant Supplier.
This does not prevent any rights a Client may have directly against Adventis under applicable law.
34. NO WAIVER OF LEGAL RIGHTS
Nothing in these Terms is intended to:
- waive a consumer right that cannot legally be waived;
- exclude liability that cannot legally be excluded;
- limit statutory protections that apply to the Client; or
- create an unfair or unreasonable contractual term.
If any provision is found to be unlawful or unenforceable, that provision will be modified or severed to the minimum extent necessary while the remaining provisions continue to operate.
35. INDEMNITY
To the extent permitted by law, you agree to reimburse Adventis for reasonable losses, costs or expenses arising directly from:
- your unlawful conduct;
- your material breach of these Terms;
- your intentional or reckless misconduct;
- damage you intentionally or recklessly cause to property; or
- false or materially incomplete information supplied by you,
except to the extent that the loss resulted from Adventis's own unlawful conduct, negligence or other liability that cannot legally be excluded.
36. COMPLAINTS
We want Clients to have an excellent experience.
If something goes wrong during your Journey, you should notify Adventis or the relevant Supplier as soon as reasonably possible.

Our Privacy Policy forms part of the overall relationship between Adventis and the Client where applicable.
38. CONFIDENTIALITY OF CLIENT INFORMATION
Adventis recognises that luxury travel may involve private information concerning a Client's family, movements, preferences and personal circumstances.
We will use reasonable measures to protect such information and will disclose it only where reasonably necessary to provide the requested services, comply with law, protect safety or otherwise as permitted by our Privacy Policy and applicable law.
39. MINORS
Where a Journey includes a minor, the parent or lawful guardian remains responsible for:
- providing accurate information;
- ensuring appropriate documentation;
- ensuring compliance with age restrictions;
- obtaining required permissions;
- supervising the minor where required; and

Certain Suppliers or activities may impose minimum age requirements.

42. DONATIONS AND CHARITABLE CONTRIBUTIONS
Where Adventis facilitates or recommends a donation to a third-party organisation, that organisation is independent of Adventis unless expressly stated otherwise.
Adventis does not guarantee the tax deductibility of any donation.
Clients should obtain independent tax advice regarding whether a donation qualifies for a deduction in their country of residence.
43. TAXES
Clients are responsible for understanding and paying any personal taxes, duties or charges applicable to them.
Travel pricing may include certain taxes and government charges and exclude others, as specified in the applicable quotation.
44. GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory consumer-protection rights that apply to the Client under applicable law.
45. JURISDICTION
Subject to mandatory applicable law, disputes arising from the relationship between Adventis and the Client shall be subject to the jurisdiction of the competent courts of South Africa.
Nothing in this clause prevents a consumer from exercising a mandatory legal right to bring proceedings in another jurisdiction where applicable law provides that right.
46. DISPUTE RESOLUTION
The parties should first attempt to resolve disputes amicably and in good faith.
Where appropriate, the parties may agree to mediation before commencing formal proceedings.
Nothing in this clause prevents either party from seeking urgent or legally necessary relief.
47. ELECTRONIC COMMUNICATIONS
The Client agrees that Adventis may communicate electronically, including by:
- email;
- online booking systems;
- electronic invoices;
- messaging applications;
- electronic documents; and
- other reasonable digital means.

The version applicable to a confirmed Booking will generally be the version accepted at the time of confirmation, together with any specific Booking terms subsequently agreed.
Updated website Terms may apply to future enquiries and Bookings.
50. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
51. ENTIRE AGREEMENT
These Terms, together with:
- your accepted quotation;
- Booking confirmation;
- applicable itinerary;
- applicable Supplier terms;
- payment terms;
- cancellation terms; and
- any specific written agreement between Adventis and the Client
constitute the agreement governing the relevant Journey, subject to applicable law.
52. NO IMPLIED GUARANTEE OF EXPERIENCE
